The Treasury has appointed three investment banks as joint lead managers for the sale of a minority stake in power generator and retailer Mighty River Power.
The companies are First New Zealand Capital / Credit Suisse Australia, Macquarie Capital New Zealand and Goldman Sachs New Zealand
They will be responsible for project management, consultancy, execution and advisory services for the initial public offer (IPO), Treasury said.
The Treasury has also appointed Bell Gully as its legal advisor.
The Government has said it expects to proceed with the sale of up to 49 per cent of the company later this year.

Greens link decision to privatisation
The Green Party is suggesting the decision to quit the wind farm project might be connected to plans to partly privatise it.
The Government plans to sell up to 49% stakes in Meridian Energy, as well as Mighty River Power, Genesis Energy and Solid Energy.
Greens energy spokesman Gareth Hughes told Summer Report that Meridian's decision might be connected to the privatisation plans.
He said a $2 billion project that had dragged on for years would have caused investor uncertainty.
Mr Hughes said the decision showed the need for good Resource Management Act processes.
"The risk of fast-tracking, which is what we're seeing under the current government, is that these projects might go ahead without people actually getting a say."

Unsurprisingly, apart from tweaking a few conditions, the final decision issued by Judge Shonagh Kenderdine is little changed from the draft decision. This is a sorry day for NZ. A retired judge has endorsed turning the Tararua Ranges into a modern day version of Magnitogorsk, running roughshod over PN residents and banning the Pahiatua fault line, right under the wind farm, from a "rupture".
NB Magnitogorsk stood at the forefront of Joseph Stalin's Five-Year Plans in the 1930s. It was a showpiece of Soviet industrial "achievement."

What Salby found though, was nothing like what was expected
The largest increases year-to-year occurred when the world warmed fastest due to El Nino conditions. The smallest increases correlated with volcanoes which pump dust up into the atmosphere and keep the world cooler for a while. In other words, temperature controls CO2 levels on a yearly time-scale, and according to Salby, man-made emissions have little effect.
The climate models assume that most of the rise in CO2 (from 280 ppmv in1780 to 392 ppmv today) was due to industrialization and fossil fuel use. But the globe has been warming during that period (in fact since the depths of the Little Ice Age around 1680), so warmer conditions could be the reason that CO2 has been rising.
Salby does not dispute that some of the rise in CO2 levels is due to man-made emissions, but found that temperature alone explains about 80% of the variation in CO2 levels.
The up and coming paper with all the graphs will be released in about six weeks. It has passed peer review, and sounds like it has been a long time coming. Salby says he sat on the results for six months wondering if there was any other interpretation he could arrive at, and then, when he invited scientists he trusted and admired to comment on the paper, they also sat on it for half a year. His speech created waves at the IUGG conference, and word is spreading.
A book will be released later this year: Physics of the Atmosphere and Climate.

The wind farm is all about exploiting carbon trading, but carbon trading has collapsed internationally.
Deloittes Australia has warned that carbon credit fraud is “the white collar crime of the future"....

The issues are clear cut. The wind farm does not meet RMA guidelines. It is right on the Wellington fault line. It uses a fraudulent noise standard. It is founded on a contractual arrangement with PNCC which blatantly and arrogantly flouts democratic principles and human rights. It seeks to impose massive invasive infrastructure which was deliberately never aired at the hearings. There are many other issues, but these alone are more than enough to scupper the project outright. The 20 working days to finalise a decision have now been passed TWICE.

DID THE DRAFT DECISION RAISE MORE ISSUES THAN HAD BEEN ADDRESSED?

One can only hope that Turitea Board of Inquiry members, Judge Shonagh Kenderdine, Richard Heerdegen, John Hudson, David Bunting, Chris Shenton, are keeping up with the flood of new and vital information regarding wind farms.

A very strong warning from across the Tasman
After reading the above, Joseph Poff's claim in his submission to be suffering from depression is possibly caused by wind turbine syndrome, the
result of living near the Te Rere Hau wind farm.

Some key issues
Submitters have been denied meaningful photomontages of turbines and infrastructure, ie substations and transmission lines, relative to the areas where they live, for 5 years. Noise expert, Dr Bob Thorne, in his submission ( Adams, John )draws attention to the fact that it is unheard of for an applicant to design the noise conditions it will adhere to, let alone a Judge and Board knowingly condoning turbines which they know will not comply. The ( clickable ) view above from the centre of the city has not been updated by either the Board or MRP.

Submissions sent to MFE by 20th June now available.
What should be the final opposing submissions, accessible below, are in our opinion, the death of this utterly shonky process and the scandalous Turitea wind farm. They are detailed, compelling, comprehensive and professional.

On the other hand, greedy wind farmer aspirants, Joseph Poff and John and Kathy Love, make unbelievable gaffs and own goals in their ridiculous rent seeking missives to the Board. The Loves go to absurd lengths to make "their" turbines invisible to their neighbours, suggesting everything other than turning them upside down. Poff, as he has in the past, makes nasty, personal attacks on his neighbours, then feigns horror that his reputation is under attack.

We believe the submissions are only here because of pressure applied to the MFE. MFE promised to send submitters an email with a link to the submissions. This was not done until Thursday the 30th June.

No one with an ounce of integrity would sign off this wind farm, not withstanding it is right on the Wellington fault line.

PNCC to make itself look like it is abiding by the notorious CONTRACT it signed with MRP, gave its submission, ( yes, you read that right! ) to MRP to comment on BEFORE the due date. This potentially gives MRP the opportunity to re-litigate this indefensible project.

A potential tragedy has become a complete farce.

Heffernan telling porkies, a typical MRP
approach to being socially responsible

Dr Heffernan is on record as extolling the virtues of geothermal, i.e.
"operates 24/7 so that it is not dependent on the climate like the wind".

In this interview Dr Heffernan claims that the Ngatamariki geothermal project
"will be funded off our balance sheet".
Why does this same business capability not extend to the Turitea wind farm
in light of MRP's bleating about viability?

In his submission Mr Henry's statements on the importance of wind generation
to MRP's energy portfolio are inconsistent with the virtues of geothermal
extolled by Dr Heffernan.

International carbon trading market a candidate for failure

Public Statement
Is MRP desperate to have a consented wind farm of 216MW on its books for the SOE sell off?
(We believe it is a book asset only because, who in their right mind would build a wind farm on a fault line).

If so, MRP would be wise to avoid further delay by negotiating buy outs for properties where consent conditions will not comply rather than arrogantly
trampling on residents.

Alternatively, MRP could withdraw from this ill-fated proposal which has become an albatross around its neck and recover its costs from PNCC, which presumably it can do under the bizarre wind farm agreement.

Has a behind the scenes deal been done between PNCC and MRP, now that there are in fact two wind farms? We strongly suspect a further amendment to the original secret contract has been made and the Board of Inquiry may be aware of this.
  Have the directors read MRP's arrogant response to the draft decision? Are the directors aware that MRP is screwing nearby residents and MRP is not living up to its mantra of being there for communities and the communities they operate in?

John Maassen legal counsel for PNCC said he was "over the moon with the
Draft Decision". Because Maasseen is legal counsel for PNCC does this mean
PNCC was over the moon also?? Was Masseen the legal counsel advising PNCC on the wind farm agreement, or did PNCC act without legal advice??

Some key points made by those opposing.

The consented wind farm is on a known, very dangerous, active fault line.
Earthquake fault lines
The secret contract between MRP and PNCC driving the process is dubious.
A $3 million penalty hangs over PNCC if it helps ratepayers affected by the project. PNCC is legally bound to give every assistance to MRP and to not oppose.

Submitters are saying the draft decision is riddled with inaccuracies and inconsistencies, makes serious omissions, provides no clear evidence as to why particular decisions are made, shows clear bias towards the applicant, fails to follow RMA guidelines, follows a predetermined politically driven course of action, ignores natural justice and legal precedents, ignores blatantly obvious geological risks, breaks a legal covenant to protect endangered species, turns a blind eye to perjury, ignores the Code of Practice for expert witnesses, fails to discuss openly secret MOU's, hides infrastructure considerations from those most affected, allows turbines to cast shadow flicker and potentially debris over a state highway, fails to remove turbines dominating many properties, ignores advice from highly qualified noise and landscape experts, without naming, insults a submitter, makes a gratuitous insult against an expert witness, repeats a lie about the location of the wind farm, creates two wind farms, which by rights need a separate and new resource consent application, and that's just for starters .........

MRP basically attacks Judge Kenderdine for not giving it all it wanted, demands the hearings be reopened, sets the scene for forcing the dubious contract with PNCC to be given full force, demands that, contrary to RMA guidelines, economic considerations are all that matter. Basically, stuff the residents and the environment.

MRP appears to have no concerns with serious traffic issues either. Is this the SOE which "works with communities?" Kahuterawa residents who have submitted are up in arms about this.

So what will MRP be worth when it is up to 49% privatised after the election? Investors will certainly mark it down as they won't want a bar of non performing "assets" such as wind farms.
Why doesn't MRP just walk away? Is this all about putting a wind farm on their books?

A real gem is found in Haack's submission where he states

" My main concern is the removal of two of wind turbines(WT95 WT96) from the proposal. These were going to mean that I had a part share in the income from these with my neighbour and therefore would mean that the income from my small farming operation would be augmented and I would be able to pay my mortgage a bit easier. It may mean that I will need to sell the property, although this is now very difficult with the drop in values due to the encroaching turbines from the other sites. I’m gutted."

Approximately 660 submitters, virtually all opposing the wind farm, have not submitted this time round, as they have been lulled into a false sense of security, believing the wind farm will never be built.

PNCC, on the other hand, having been derelict in its duty towards those it is by law meant to serve, is running scared, and is trying to "use" the Judge to escape from a certain lawsuit.

Submissions on the Draft Decision have now closed. We will post summaries and links this week. A preliminary look at a number of submissions from both sides indicates that the Draft Decision is open season for both opposers and supporters.

What the Board of Inquiry ignores.

An earthquake "as big as Japan" would devastate much of the lower and central North Island, if the Pacific and Australian plates were to rupture releasing all their energy.

The magnitude 9 or larger earthquakes occur at plate boundaries, and if one took place beneath Wellington, most of the North Island would move closer to Chile by up to 50 centimetres in less than one minute, GNS Science says.

Update on Kahuterawa traffic issues.

Mighty River Power met with a group of residents on the 19^th of April to confirm a traffic plan for the southern end of the wind farm. Despite instructions from Judge Kenderdine for PNCC to be involved no one from the council fronted. Residents expressed their deep concerns about thousands of truck movements impacting on their currently peaceful existence and in particular the potential for serious injury and or death for residential and recreational users. Local landowners at the meeting who stand to benefit from the wind farm showed no such concern, but their voice was a small minority. The meeting was inconclusive and Mighty River Power showed great reluctance when a further meeting was requested to properly discuss safety issues.

Why did PNCC not appear?
Is it anything to do with the contract between PNCC and Mighty River Power?
Does this mean PNCC has unlimited financial exposure to Mighty River Power?
Has it changed from being a willing landlord?

Further important questions

1. How much money has PNCC paid for legal fees to do with the Change in purpose of the Turitea reserve through to the present wind farm hearing?
2. Is it correct that legal advice, amounting to big money, has considered all possibilities down stream?
3.If that is the case why has PNCC ended up in the present predicament,i.e. sacrificing a popular recreational and cycling area for wind farm construction while at the same time promoting safe cycling?

City ratepayers will be shocked to see what our council has done.
It has made a pact with the devil, which destroys the environment, compromises the city’s water supply and ruins the amenity and property values of a large number of residents. The city already has an unsustainable debt and with this Mafia like contract it could get much, much worse. Note: the section of the contract quoted below was taken from the public record of the Board of Enquiry hearings.

TURITEA WIND FARM DEVELOPMENT AGREEMENT
“10.1 Council to support
The Council agrees in its capacity as landowner( and subject to clause 17.2) to :
(a) Support any application by Mighty River for the grant, renewal. Variation or continuation of any Consent necessary to give effect to Mighty River’s rights under this Agreement including consent for the lease;
(b) Support Mighty River’s negotiations with Adjacent Owners, as requested by Mighty River; and
(c) Provide such written evidence of this support (and any consent or approval) as Mighty River may reasonably require.”
and
10.2 Council not to oppose.
The Council agrees in its capacity as landowner (and subject to clause 17.2) that it will not, either directly or indirectly:
(a) object to, oppose or impede
(1) any application by Mighty River for the grant, renewal, variation or continuation of any Consent necessary to give effect to Mighty River's rights under this agreement, including without limitation a subdivision consent for the lease;
(11) any action taken by Mighty River to give effect to Mighty River's rights under this Agreement; or
(111) the granting to Mighty River of any lease, restrictive covenant or easement necessary for the Wind Farm Project or the Investigation; or
(B) fund, facilitate or promote any person, entity or group to take any action that would be in breach of this clause 10 if done by Council.
12.2 D “The liability of Council (other than in its statutory capacity) for breach of this contract or for any negligent act or omission shall be limited to $3,000,000 in aggregate during the term of this Agreement. This limitation of liability shall not apply to deliberate acts or omissions of Council that breach this Agreement.”

Corruption permeates the proposed Turitea wind farm disaster, approved right on a fault line, and towering over Palmerston North. The image at the top of the page is the view from the centre of Palmerston North.Thousands of properties on the marine terrace on the other side of the Manawatu River are right under the wind farm. The wind farm is in the city's water supply and last remaining native forest, home to endangered and protected falcons.

Mighty River Power will shortly be partly publicly owned under an asset sales programme. No private investor in his right mind is going to countenance owning inefficient, noisy, obtrusive, extremely expensive, unpopular wind farms in residential areas to satisfy the whims of politicians wedded to thermogeddon.

Genesis Energy are more astute and intelligent than Mighty River Power. Genesis Energy is proposing the 600MW (or possibly 858MW) Castle Hill Wind Farm well away from rural residential property and they have squared off with all affected parties beforehand to ease the RMA process.

To all recreational users of Kahuterawa and Greens Roads and the Kahuterawa Recreational Area, including Scotts Road.

Your enjoyment of these areas will come to an end when Mighty River Power starts using Kahuterawa and Greens Roads to construct its wind farm.

An endless stream of trucks will make the roads too dangerous for 3 to 5 years.

It is highly likely the end of Kahuterawa Valley will be used to link a resurrected Motorimu wind farm with the Turitea wind farm.

THERE is "no doubt" wind farms have a negative effect on the value of adjoining properties, according to a senior rural real estate agent.

Elders Rural Services national sales manager Shane McIntyre said the towers were seen by most of the market as "repulsive" and could lead to a 30 to 50 per cent drop in the value of the land.

In an email to a member of the anti-windfarm group, the Landscape Guardians, seen by The Weekly Times,

Mr McIntyre said a proliferation of wind towers adjacent to a property had the same effect as high-voltage power lines, rubbish tips, piggeries, hatcheries and sewage treatment plants.

This meant, he said, that "if buyers are given a choice, they choose not to be near any of these impediments to value".

But wait, there's more - Noise standards paving the way for billion-dollar wind-farm developments across the country are biased and should be ripped up, academics say.

The wind-energy industry exerted undue influence in setting new noise levels for the country's wind farms, opponents of the standard say.

Meeting minutes and voting papers of the Standards New Zealand committee on wind-farm noise, released under the Official Information Act (OIA), show:

Six of 12 members were either wind-farm consultants, worked for a power company or were members of the Wind Energy Association, which partly funded the committee.

Concerns of AUT University public health senior lecturer Dr Daniel Shepherd about committee membership and the standard were dismissed as irrelevant by its members and as having "nothing of substance" they needed to deal with.

Strong opposition from committee member Professor Philip Dickinson to the standard, including his view that several statements in the draft standard were "blatantly false".

The Energy Efficiency and Conservation Authority's (Eeca) wish for a medical review of the proposed standard was overruled because the committee felt it was difficult to identify someone suitably qualified to do it and because of "what would be achieved by it".

A wind-farm expert working with wind-farm developer Meridian Energy, Malcolm Hayes, was allowed at a meeting, but anti-wind-farm lobbyist and author Nick Jennings was not.

The minutes show that as early as its first meeting, on July 10, 2008, committee members shied away from tougher turbine guidelines for power companies after Dickinson suggested 30 decibels (dBA) should be the maximum amount of turbine noise allowed to be heard inside a bedroom.

"A level of 35dBA was mentioned as a significant restraint for operators of wind-turbine generators to achieve under higher wind speeds, "the minutes said.

Two ballots were held, and three members who opposed the standard in the first vote supported it in the second, although one who initially supported it ultimately decided to abstain.

Committee chairman Stephen Chiles, who is advising Meridian on its proposed Project Hurunui wind farm in North Canterbury, told The Press the revised code was more stringent than its 1998 predecessor. The committee reviewed but did not change the lower limit from 40dBA of sound audible at a dwelling, or background noise levels plus 5dBA, although did lower it to 35dBA for areas of high amenity value.

District plans generally allowed for 40 to 45dBA at night, "but a handful in rural areas allow for a limit of 35", he said.

Greta Valley businessman John Carr requested the committee papers as part of his campaign against the planned Project Hurunui wind farm and other proposed developments in North Canterbury. He said the OIA documents showed the new standard had been "tainted".

A truly independent committee should be formed to produce a new standard. Until such time, no district council or the Environment Court should consider any consent application from a wind energy company." Dickinson, the Massey University representative, voted against the standard in both ballots.

In comments on his first vote, he said the standard underestimated the sound residents would hear from turbines. Several statements in the draft standard were "blatantly false", he said.

In the second ballot, Dickinson called the standard "totally unacceptable" and labelled parts of it "arrogant and misinformed" and "totally false".

"If the standard progresses to be adopted in this form, the university will demand there be a short statement after the committee representation, saying: `The Massey University representatives did not agree to this standard as written, considering it to be ethically and scientifically wrong'."

The paragraph was not included in the published standard. Instead, it said while Dickinson did not support it, he recognised "the revised standard is an improvement on the original".

Shepherd wrote to the committee in August 2008 questioning committee membership and saying health expertise was under-represented in favour of acoustics.

"It is understood some of the members of the review committee are acoustic consultants working for wind-farm developers. It is also understood that in forming the panel, a number of scoping group members have been excluded because their opinions do not align with those organisations sponsoring the standard.

"The inclusion of individuals enjoying financial arrangements with the sponsoring organisations and the exclusion of those not aligned with the sponsor immediately exposes the standard to critical evaluation that it cannot credibly defend."

Minutes show the committee said there was "nothing of substance" in Shepherd's comments.

After receiving no reply, Shepherd wrote again more than a year later saying it was disappointing little had been done to correct the standard's "substantial deficiencies".

"One issue that still remains is that committee members have not sufficiently declared, nor has Standards New Zealand sufficiently acknowledged, conflicts of interest."

In October 2009, Shepherd finally received a reply saying the committee was aiming for a standard with "reasonable balance".

Chiles defended the committee process as "very robust".

"The types of questions that John Carr and others are raising now were anticipated. We were fully aware that everything we did would be under intense scrutiny," he said.

"All those bodies who have an axe to grind will be represented on the committee. You also have to have wind-farm operators with the technical knowledge to write a meaningful standard. It's a consensus-based process."

Hayes had been invited to attend a meeting because he was a "world-leading expert", but Jennings was a layperson who had picked up on a body of research on vibro-acoustic disease, supplied the committee with a bundle of papers and wanted to present that. "We didn't see the need for a layperson to take us through the process."

Ruth Paul , who represented the Executive of Community Boards, changed her vote from "no" to "yes" after working with Wind Energy Association chief executive Fraser Clark and Meridian employee Paul Botha on a lower turbine noise limit of 35dBA for quieter areas.

I refer to the letter published in last

week’s edition by John Adams titled No

support for Fraser Clark’s view.

He stated he was unable to find a

list of the committee members for the

new noise standard Acoustics-Wind

Farm Noise NZS6808-2010 published in

February.

It was noted in the standard that

Dickinson did not support it.

The committee was funded by the
Wind Energy Association and Energy
Efficiency Conservation Authority.

Note the discrepancy in the whitewash from NZ Standards on page 22 where the 12 members of the committee came from 11 organisations. No mention that one organisation provided two members for the committee. Guess which one.

Professor Dickinson a dissenting acoustics expert on the panel has trashed Clark and his merry band of burglars.

"Dickinson said the prediction for wind farm noise in the NZ standard will always under-predict the noise by 20 decibels, adding that the ISO standard for this noise was written for application in buildings, not specifically for wind farms.

However, the final word goes to Rapley, who suspects that the country's noise standards have been made as "blindingly, scientifically stupid as practically possible to make it as confusing as possible to regulate, which allows people to make it as noisy as they want".
